These terms govern the use of WFSuite — the web platform at www.wfsuite.it and the WFSuite mobile app — provided by DevSoft Express SRL, Str. Arh. Ionescu Grigore 63, Bucharest, Romania, trade register J40/5827/2017, VAT RO37446712 (“we”).
1. The service
WFSuite lets companies (“customers”) record their employees' working time and manage leave, shifts and workplaces, and lets employees do the same from the web or the mobile app. The features available to a customer depend on its plan and on the features it turns on.
2. Accounts
- A customer creates its company account and the accounts of its employees, and is responsible for the users it creates and the roles it assigns.
- Employees use WFSuite as part of their work, under their employer's account and rules; the employment relationship itself is outside these terms.
- Keep your password and your QR badge to yourself, and tell your administrator straight away if you think someone else has used them.
3. Acceptable use
You must not record punches for someone else or falsify locations, photos or times; try to reach the data of other users or companies; disrupt, overload or reverse-engineer the service; or use it for anything unlawful.
4. Customer data
The data entered in WFSuite belongs to the customer. We process it only to provide the service, as described in the privacy policy and in the data processing agreement with the customer. The customer is responsible for having a lawful basis for the data it collects through WFSuite (for example location and photo checks at clock-in) and for informing its employees.
5. Plans, trial and payment
Prices, limits and billing periods are those of the plan chosen in the control panel or agreed in writing. A subscription left unpaid may be limited or suspended after notice. A trial ends automatically unless a plan is chosen.
6. Availability and support
We work to keep WFSuite available and secure, but we cannot guarantee uninterrupted operation: maintenance, updates or events beyond our control may make it temporarily unavailable. The mobile app keeps punches made without a connection and sends them later. Support is provided as described on the support page.
7. Intellectual property
WFSuite — its software, design and content — belongs to DevSoft Express SRL. The customer receives a non-exclusive, non-transferable right to use the service for the duration of its subscription.
8. Liability
The customer remains responsible for its payroll, for how it uses attendance records and for its obligations towards its employees. As far as the law allows, our liability is limited to the amounts the customer paid for the service in the twelve months before the event, and we are not liable for indirect damage or lost profits. Nothing in these terms limits liability that the law does not allow to be limited.
9. Termination
The customer may stop using WFSuite at any time. We may suspend accounts that breach these terms. After termination the customer can ask to export its data; we then delete it as described in the privacy policy.
10. Changes to these terms
We may update these terms; the date at the top shows the last revision. We inform customers of substantial changes in advance; using the service after they take effect means accepting them.
11. Governing law and disputes
These terms are governed by Romanian law. Disputes are settled by the competent courts of Bucharest, without prejudice to the mandatory rights that employees or consumers may have under the law of their own country.
